The Federal High Court sitting in Osogbo, Osun State Capital today, 13th October 2025, sat on a case instituted by the APC reinstated Chairmen and Councilors on 13th September, 2025 for determination of their tenure of office and the validity of the Local government Councils election allegedly held on 22nd February, 2025 by the Osun State Independent Electoral Commission (OSSIEC).
In Suit No. FHC/OS/CS/147/2025 between Onibonokuta Saheed & 7 Ors v AGF & 6 Ors, the Claimants seek among other reliefs whether they are entitled to 3 years in office commencing from February, 2025 and whether the OSSIEC could validly on 22nd February, 2025 conduct elections into the same offices during the subsistence of their tenure of office.
When the matter came up today, Hon. Justice Adefunmilola A. Demi-Ajayi said that being a political matter, the court would want to have the matter determined expeditiously.
Meanwhile, Muhydeen Adeoye Esq., counsel for the Claimants introduced a motion for restraining the Defendants from disturbing the Claimants in office while the substantive suit pends but F. K. Labo-Popoola Esq., counsel for the 3rd & 4th Defendants and Rachael Ojomi Esq., counsel for the 5th Defendant and J.A Ayanyemi Esq., counsel for 6th Defendant said they were still within the time to react to the main Summons, the judge therefore found out from the court record that service is not yet complete and that the counsel should ensure that the process is served on all the parties before the next date of adjournments.
The Defendants are the Attorney-General of the Federation, the Inspector General of Police, Attorney-General for the State and Osun State Government. Others are the Osun State House of Assembly and the Osun State Independent Electoral Commission.
Case was thereafter then adjourned to 27/11/2025 for hearing.
